GENERAL ZONING REQUIREMENTS 


If you are unsure where your property lines are located, you may view a map of your property dimensions on the Montgomery County Auditor’s website at www.mcrealestate.org.  Visit the GIS mapping feature or the property search feature to look-up any property details. 


Residential Accessory Structures

1. The total combined footprint of all accessory structures on an individual parcel cannot occupy more than 35% of the rear yard.

2. Detached accessory structures (such as sheds) that are larger than 100 square feet will require a zoning certificate and must be placed at least six (6) feet from the property line in what is defined as the rear yard of the property. 

3. Sheds less than 100 square feet do not require a zoning certificate and must be placed at least three (3) feet from the property line in what is defined as the rear yard of the property.

4. Pools must have a perimeter fence that is at minimum 42" tall or have a lockable cover.  Pools under 100 square feet do not require a permit but must also include a fence or a lock-able cover.

5. Be certain to check with Montgomery County Building Regulations or call (937) 225-4622 to see if any building permits are required by Montgomery County.


Residential Fences

1. Fences may not be taller than 6' in the side or rear yard of a property and may not be taller than 42" in what is considered to be the front yard.

2. Any portion of a property that is located between the property line and the fence must be maintained by the property owner.

3. The shape and orientation of a property determines what is considered a front yard.  Corner lots, double frontage lots and others may have what is considered two front yards.  Contact a member of our staff at planning@miamitownship.com should you have questions about your particular property.
